DC Proposes Changes to 30-Year Underground Storage Tank (UST) Removal Requirement

In February 2020, the District of Columbia finalized a rule requiring owners and operators of underground storage tanks (USTs) more than thirty (30) years old to remove them from the ground within five years. The intent was to address the risks associated with aging infrastructure and the potential for leaks or failures.

Now, regulators are proposing a significant change. Instead of forcing all 30+ year-old USTs out of service by a set deadline, the District would allow these tanks to remain in operation—provided they pass a tank tightness test every three years.

What the Proposed Rule Means

Here’s the key language of the proposal:

  • Older USTs may remain in service if they pass a tightness test every three (3) years.

  • If a tank fails, the owner or operator must permanently close it within one (1) year of the failed test.

  • The original five-year removal requirement would no longer apply.

A Shift Toward Performance-Based Compliance

This proposal reflects a broader regulatory trend: moving away from rigid age-based mandates and toward performance-based compliance. Instead of assuming older tanks are unsafe, regulators are focusing on proven performance and testing results.
