EPA Intensifies Enforcement on UST Compliance Along the East Coast

The U.S. Environmental Protection Agency (EPA) has recently heightened its enforcement actions concerning Underground Storage Tank (UST) compliance along the East Coast. This initiative aims to ensure that UST owners and operators adhere strictly to federal and state regulations designed to protect the environment and public health.

Recent Enforcement Actions

In 2022, EPA inspections uncovered that several companies operating along the eastern seaboard had deficiencies in their UST operation and maintenance programs. These deficiencies included failures to meet operator training, record-keeping, and leak detection requirements. As a result, in October 2023, the EPA reached settlements with these companies, imposing fines ranging from $26,500 to over $40,000 per company.

Common Compliance Violations

The EPA has identified several common violations among UST operators:

  • Failure to maintain leak detection systems or equipment

  • Inadequate corrosion protection measures for tank components

  • Failure to perform required inspections and testing

  • Improper handling and disposal of hazardous materials

  • Lack of documentation or recordkeeping for inspections, testing, or maintenance activities

  • Failure to demonstrate financial responsibility for cleanup and remediation in the event of a release

  • Non-compliance with requirements for tank closure and removal

  • Improper handling of UST system upgrades or modifications

These violations not only pose significant environmental risks but also expose operators to substantial financial penalties.

EPA’s Enforcement Strategy

The EPA’s enforcement strategy focuses on ensuring compliance through regular inspections and holding violators accountable. The agency’s Office of Enforcement and Compliance Assurance (OECA) provides guidance on enforcement policies and procedures related to UST regulations.
